By placing an order with us, you agree to be bound by these Terms of Sale, along with our Terms of Use and Privacy Policy. 1. Products and Offerings Covered These Terms apply to any offering sold by or through DIU, including but not limited to: • physical books, collector editions, posters, apparel, merchandise, collectibles, and bundled products • digital books, downloadable files, access products, digital collectibles, and memberships • pre-orders, reservations, launch tiers, founder access, lore access, and limited edition drops • community, ARG, event, or early-access products • any other products or services expressly offered by DIU Certain products may also be subject to additional product-specific terms displayed at checkout or on the relevant product page. 3. Order Acceptance All orders are subject to our acceptance. We may refuse, limit, cancel, or decline any order at our discretion, including in cases involving: • pricing or listing errors • suspected fraud, abuse, or unauthorized activity • product unavailability • duplicate or excessive quantity orders • restrictions related to geography, payment verification, or compliance An order confirmation does not necessarily mean final acceptance. We do not store complete card or payment credentials. Pre-Orders, Reservations, Tiers, and Early Access Certain DIU offerings may be sold as: • pre-orders • reservations • early access tiers • limited drops • founder or launch-phase access products By purchasing such offerings, you acknowledge that: • these may be released, fulfilled, activated, or delivered on an estimated timeline only • specifications, formats, artwork, contents, packaging, access scope, or timelines may evolve • some items may be produced in limited quantities or in batches • DIU may modify, delay, replace, split, reschedule, or discontinue an offering where reasonably necessary Unless expressly stated otherwise, pre-orders and launch-phase access products are intended as early participation in the DIU ecosystem and do not guarantee any fixed future release schedule. 7. Digital Products and Access Products For digital goods, downloads, memberships, access products, community products, or any product delivered electronically: • delivery may occur immediately, in stages, or within a reasonable time after successful payment • access may be provided by download, email, account activation, invite, code, or other electronic means • digital products are licensed, not sold, except to the extent expressly stated otherwise • once a digital product is delivered, accessed, unlocked, or activated, it is non-returnable and non-refundable, except where required by law You may not: • reproduce, share, resell, sublicense, distribute, or exploit digital products • upload them publicly or privately for redistribution • copy or extract protected materials, files, story systems, lore structures, or proprietary content 8. Physical Product Shipping and Delivery For physical goods: • delivery timelines are estimates unless expressly stated as guaranteed • dispatch may vary depending on stock, production cycle, preorder status, geography, logistics partner constraints, and force majeure events • shipping charges, if any, will be shown at checkout or otherwise communicated before payment • risk in physical goods generally passes upon delivery to the shipping address provided by you, subject to applicable law You are responsible for ensuring that the shipping and contact details provided are accurate and complete. We are not responsible for delays caused by: • incorrect address details • failed delivery attempts • customs clearance • courier delays • strikes, disruptions, or events beyond our control 9. Cancellations, Returns, Refunds, and Replacements A. Digital products All digital goods, access products, memberships, unlocked content, and electronically delivered items are final sale and are not eligible for cancellation, return, or refund once delivered, activated, or accessed, except where required by law. B. Pre-orders and limited drops Pre-orders, limited drops, collector products, and launch-phase products may not be cancelled once production, allocation, customization, batching, or fulfilment processing has begun. If we permit cancellation before that stage, any applicable payment processing or platform charges may be deducted where lawful. C. Physical goods Physical goods may be eligible only for: • replacement, or • refund / store credit at our discretion or where required by law, if: • the wrong item was delivered • the item arrived materially damaged • the item has a genuine manufacturing defect To request support, you must contact support@divineintelligenceuniverse.com within the stated support window mentioned on the relevant product page or, if none is stated, within 48 hours of delivery, with: • order number • description of issue • clear unboxing / product photos or video where reasonably requested We reserve the right to reject claims that are: • late • incomplete • abusive • unsupported by reasonable evidence • based on minor variations in color, packaging, or artistic presentation that do not constitute defect 10. No Resale / No Commercial Exploitation Unless expressly authorized in writing, products and services purchased from DIU are for personal, non-commercial use only. You may not: • resell launch access, tier positions, or limited entitlements • commercially exploit DIU goods or digital content • misrepresent DIU affiliation • use any DIU product as source material for derivative commercial works 11. Intellectual Property All DIU offerings, including product packaging, copy, lore, digital files, characters, names, symbols, systems, art, visuals, designs, and related materials, remain the exclusive intellectual property of DIU Labs Private Limited, unless otherwise expressly stated. Purchase of a product does not transfer any ownership of DIU intellectual property. 12. Nature of the DIU Universe Divine Intelligence Universe™️ is an original fictional cinematic and literary universe. Its products, storylines, characters, terminology, and world systems are created for storytelling, entertainment, collectible, artistic, and community purposes. Nothing sold by DIU constitutes: • religious instruction • historical fact claim • scientific guarantee • spiritual, legal, financial, or professional advice 13. Limitation of Liability To the fullest extent permitted by law: • all products and services are provided on an “as available” and “as is” basis • DIU disclaims warranties except as expressly required by law • DIU shall not be liable for indirect, incidental, special, punitive, or consequential damages • our aggregate liability relating to any order shall not exceed the amount actually paid by you for that specific order Nothing in these Terms of Sale excludes liability that cannot be excluded under applicable law. 14. Force Majeure We shall not be liable for failure or delay caused by events beyond our reasonable control, including but not limited to: • natural disasters • war • government restrictions • internet or power failures • platform outages • cyber incidents • logistics failures • labor disruptions • third-party system failures 15. Governing Law and Jurisdiction These Terms of Sale shall be governed by the laws of India. Subject to applicable consumer law, courts at Bengaluru, Karnataka shall have exclusive jurisdiction over disputes arising out of or relating to these Terms of Sale, your order, or any DIU product or service. 16.
